Numbers look good, it appears that they installed a 36 long block. Looks like they used the later heads. Is there any thing on the bike that makes you think its a 40 besides the tank emblems? The frame looks later than 40 because it would have have the tool box mount mounted in the higher position unless someone has ground the rivets out and drilled more holes to mount it in the lower position. It also has a WLA speedo instead of the plain face a 40 model would have. I cant tell from the pictures does it have a narrow primary cover, and the 39-41 style tail light with out the screws that hold the tag and red lenses in? 1940 also would not have had a pipe like your bike has it would have been made in with the muffler, but that could have easily been changed. Maybe you could post a picture of the neck of the frame, the back side of the rocker clutch and the primary cover looking down at it to determine if it is the 1936-40 narrow style cover.
